Broken Justice

| by Daniel J. M. Galpin | September 06, 2007
The American justice system was created to uphold the law and give justice to all throughout the land. It was a good system until it became a broken one. Those in power have eroded it into a laughing stock around the world. Lawyers obsessed with winning, criminals using loopholes and technicalities and judges thinking they're God has distorted one of the greatest legal systems ever created.

Lawyers use the client / lawyer privilege to evade bringing out the truth. If a real estate agent sells a house that he knows has a leaky roof, the agent is held responsible, yet a lawyer can know, for a fact, of his client's guilt and not disclose this material fact. If someone tells me that they murdered someone and I don't tell the police, I'm an accomplice, yet a lawyer can know every detail of the crime and is not held accountable. All this so there can be a “fair” trial. The word fair has been twisted to fit a new meaning. True fairness is to disclose ALL the material facts. The true criminals are the lawyers themselves who have created the laws that protect themselves while the profit protecting the accused.

Criminals often know the law better than the victim They play out the game to their full advantage while both the victim and police are helplessly watching. Instead of logically punishing the criminal, the victims and their families suffer. A criminal can use procedure to avoid a conviction even when guilty; some fair trial that is.

Judges have moved themselves into the place of God. They seem to think what they want is what should be, regardless of the law. They can declare what should be heard as evidence and what should not. Recently one judge even said the word rape could not be used in the court case for a man accused of raping a woman. How can the case be prosecuted if the crime for which the man is charged can't be named in court? Judges also punish the one convicted of a lesser crime more than one convicted of a greater crime as seen in the below chart. I used three high profile cases that most people should be aware of. Where's that logic? Maybe the better questions are, what drugs was that judge on? And/or how much money was transferred to his account recently?

The solution is threefold. The lawyer / client privilege must end if true justice is to esurface. Logically the criminal should suffer for the crime and if procedure has been violated, charge the violator of such. Remove the judges power allowing or not allowing evidence and created a one penalty per crime consequence so if the accused is found guilty, there's no question what the punishment will be.

In the meantime, while we're waiting for things to change, don't commit a crime unless your rich, famous or both. Your chances of getting off or getting a lite sentence is much better. Apparently the alleged quote of Lindsey Lohan is true: I'm a @#$% celebrity and can do whatever I want to!
